Nintendo banned a bunch of hacked 3DSes?

I haven't turned mine on in months, so I don't know if I'm banned, also I have zero friends on it. That won't encourage me to buy any games anymore. I buy games, dump them, keep them in mint condition.
It was a big thing backing up your games to a hard drive, back in the PS2 days. I had a thing that would let me. Didn't ever really use it though. Makes sense on the 3DS, better then carrying every game you own everywhere.
